1. Definitions

  • “Customer”: Any individual or entity placing an Order with Waltons and Company Group Ltd, whether as a private consumer or representing a business.
  • “Goods”: Any items sold or supplied by Waltons and Company Group Ltd under an Order.
  • “Waltons”: Waltons and Company Group Ltd, registered in England with company number 08317135, with a registered address at 1 Haven Close, Halifax, West Yorkshire, HX3 7EY, United Kingdom.
  • “Order”: Any request or order placed via phone, web order (excluding eBay or Amazon), or mail order to purchase the Goods.
  • “Parties”: Refers collectively to the Customer and Waltons.

2. Validity

2.1 This Agreement is the sole contract between the Parties. Any Customer terms and conditions are void unless explicitly agreed upon in writing. By placing an Order, the Customer agrees that these terms and conditions take precedence over any other agreement, except for pre-agreed Waltons Credit Account terms, which take precedence in the event of a conflict.

2.2 Acceptance of an Order by Waltons is at their discretion. Payment for Goods does not imply acceptance of the Order.

2.3 Waltons reserves the right to modify these terms and conditions by updating them on the Waltons website or catalogue.

3. Goods Sold

3.1 Descriptions and specifications of the Goods are as listed on the Waltons website or the current Waltons catalogue at the time of the Order.

3.2 Orders for specific colours, patterns, or designs are subject to stock availability. Waltons may substitute with comparable or superior items with the Customer’s consent.

3.3 If Goods are unavailable or out of stock, Waltons may cancel the Order in whole or in part, refund any payments, or issue a credit note. Variations to the Order require the Customer’s approval.

3.4 Customers ordering age-restricted goods, such as solvents and knives, confirm they are over 18 and will ensure delivery is received by someone over 18.

4. Payment Terms and Methods

4.1 Goods are priced as listed on the Waltons website at the time of the Order. Catalogue prices are indicative. In case of discrepancies, the website price prevails. Delivery and/or insurance charges may apply. All prices are in British Pound Sterling.

4.2 Unless stated otherwise, prices exclude VAT, which is charged as per regulations at the time of the Order.

4.3 Waltons is not obligated to honour prices or Orders that are incorrect due to error.

4.4 Payment options are listed on the Waltons website or catalogue. Cheques and cash need at least 6 working days to clear. The Customer’s account, order, or quote number must be referenced with payment. Waltons may withhold or refuse further shipments until overdue accounts are settled. Unpaid payments returned by a bank incur a £25.00 fee.

4.5 Waltons may charge 8% interest above the Bank of England base rate on late payments, calculated monthly.

4.6 All Orders are subject to credit or security checks.

4.7 Waltons’s Price Promise matches lower published prices for like-for-like products offered on the same terms within the UK. The competitor must have stock available at the time of ordering. Price matching excludes hidden charges such as delivery fees and applies only if the price is published in writing. Waltons’s Price Promise does not apply to products within the Waltons group of companies.

5. Delivery

5.1 Full delivery prices and options are available on the Waltons website or catalogue and may change.

5.2 Standard and Premium Delivery Orders placed by 4.00 pm on a working day aim for next-day delivery within the UK mainland, subject to availability and no extra security checks. If next-day delivery isn’t possible, delivery usually occurs within 5 days.

5.3 Offshore/remote deliveries are dispatched as soon as possible, but actual delivery times vary based on location.

5.4 Waltons strives to meet delivery estimates but isn’t liable for delays.

5.5 Risk transfers to the Customer upon delivery, but title passes only when full payment is received.

5.6 Goods are used, stored, and installed at the Customer’s risk. Waltons is not liable for damage, loss, or disruption caused. Additional terms and charges may apply for installation/disconnection services.

5.7 Large machinery, refrigeration, and flat-packed Goods are delivered kerbside only. Delivery to other locations within the premises must be agreed at the time of ordering and will be at the Customer’s own risk, and extra charges will be applied.

6. Warranties and Returns

6.1 Goods sold in the UK mainland can be returned within 30 days for a refund, exchange, or replacement if unused, saleable, and in original packaging. A 25% restocking fee will be deducted from the refund amount. Partially refunded Goods (up to 60%) must be assessed by Waltons. Non-saleable Goods are non-refundable and returned at the Customer’s expense. Hygiene-sensitive Goods and special-order items are non-returnable. Carriage costs of returns may be refunded at Waltons’s discretion.

6.2 Goods are guaranteed against defects per the manufacturer’s warranty or for one year from delivery, unless stated otherwise. Faulty Goods reported within the warranty period may be repaired, replaced, or exchanged at Waltons’s discretion. This warranty covers parts and labour in the UK mainland only.

6.3 Missing or damaged Goods must be reported within 24 hours. Large items like refrigerators should be inspected upon delivery for damage, noted on the delivery docket.

6.4 Warranties do not cover defects caused by misuse, negligence, or failure to follow instructions. Some items, like gaskets and electric lamps, are only warranted on delivery. Misuse or unauthorised repairs void warranties. Certain items, including those marked ‘semi-commercial,’ are unsuitable for heavy-duty use. Non-warranty faults or missed service calls may incur charges. Goods are not sold on a ‘sale or return’ basis without written approval.

6.5 Disposal of old electrical and electronic equipment must comply with WEEE regulations. Details are available on the Waltons website.

6.6 Customer statutory rights remain unaffected.

7. Termination

7.1 Waltons may cancel or suspend Orders where payment isn’t received as per Clause 4.

7.2 Orders may be cancelled if the Customer is insolvent, bankrupt, or under similar legal constraints.

7.3 Waltons may suspend or terminate Orders due to force majeure, adverse weather, or government actions.

7.4 Orders may be cancelled if the Customer isn’t legally permitted to purchase specified Goods.

8. Limitation of Liability

8.1 Waltons is not liable for indirect losses, business interruption, or additional damage caused by Customer’s delay in reporting faults or providing access for repairs. Statutory liability for injury or death is not excluded.

8.2 Goods are not insured for delivery unless confirmed by Waltons.

9. Intellectual Property and Confidentiality

9.1 The Customer must not infringe on intellectual property rights associated with the Goods. Breaches indemnify Waltons.

9.2 Data protection and privacy rights are outlined in Waltons’ privacy policy, available on the website.

10. Jurisdiction

10.1 This Agreement is governed by English law, and the Parties submit to the exclusive jurisdiction of the English courts.

10.2 If any part of this Agreement is deemed invalid, the remaining provisions remain in effect.
